القانون والمفتي الديني بالعراق!
بعد قرارات القيادة الرئاسية بالدول والبرلمانات وطبقآ للدستور بقوانينه التي تضمنها القرارات المهمة من الأعدام والحرب تعود الى المفتي الديني للتاكد من مطابقتها للأرادة الآلهية وأصدار الفتوى بأعتبار القتيل في الحرب شهيد واعلان الجهاد وهدر دم العدو والسماح بأعدام المحكوم قضائيآ والتصديق على الأتفاقيات مع الدول والمشاركة معها في الحرب وقرارات كثيرة يقررها مكتب المفتي العام للجمهورية , لكن في مصر العربية ودول أخرى نموذج لذلك ومنها الأزهر الذي رفض الجيش المصري القتال في الكويت ضد غزو صدام ألا بالفتوى منه بهدر دم العراقيين عام 1990م لكن بالعراق الدستور الحالي بعد الأحتلال الأمريكي للعراق عام 2003م لم يقرر ذلك وربما لأننا أصبحنا من وزارة الأوقاف والشؤون الدينية الى هيئة أوقاف أتياع أهل السنة والجماعة وهيئة أوقاف أتباع وشيعة الأمام علي بن أبي طالب عليه السلام والدستور ينص على أن العراق فدرالي أتحادي أقاليم لها شكل وتركيب الدولة التي فيها مفتي خاص بها من ديانتها ومن المذهب الذي تعتقد وتؤمن به وعليه العراق ليس دولة واحدة وأنما دول ثلاث كردية في الشمال أقليم كردستان قائم من عام 1991م والوسط للعرب السنة والجنوب للشيعة , ولكن الى اليوم التعامل مع المرجعية الشيعية في الحوزة في النجف الأشرف ممثل لهم والقرارات التي تخصهم تراجع فيها والسياسيون الشيعة فقط من يلتزم ذلك بينما العرب السنة يلجؤن الى السعودية ومصر والأردن لأنه المحاصصة جعلت الحزب الأسلامي العراقي الأخون المسلمين ممثل لهم بينما هم فرق كثيرة , والرأي لها بذلك , لكن العرب السنة لا مرجع ولا مفتي عام معلن لهم , والأديان الأخرى والأقليات لا رأي مسموع والقانون الوضعي فقط يطبق عليهم بالقوة الحكومية شاؤا أم رفضوا , كما أنه النظام السابق من نظام صدام وما سبقه ليس للعراق دستور ثابت يراعي هذا الأمر بل صدام كان لديه مجلس أنقلاب أو ثورة تموز كما يسميه و كان يقول أنا القانون كل كلمة اقولها هي تنفذ فورآ وفعلآ مثال ذلك _ في الحرب مع أيران طبق الأحكام العرفية موقعيآ وتم أعدام هاربين من الخدمة العسكرية في شوارع بغداد وطلب من أهل الضحايا عدم أقامة مراسم الدفن والعزاء بل سددوا ثمن الأطلاقات النارية وتكاليف أعدام أبناءهم وتم ذلك في الشارع أمام العامة من الناس ودون محكمة أو قرار قضائي ومن قبل فرق خاصة شكلها صدام من اهل تكريت أقاربه ومن حمايته الخاصة , القانون في العراق والتشريع الى اليوم لم يرتقي لمستوى العدالة واليوم يتم الأفراج عن المعتقلين بكفالة عضو من مجلس النواب من المحكومين بالأعدام ومنهم من نظام صدام وأمرأة عضوة برلمان بالكوتا النسائية يعني تمثل 600صوت من 40مليون عراقي تتكفل بأخراج 40موقوف من المعتقلين هي رحاب الدوري وهم من أهل الدور وتكريت جماعة صدام من المتهمين بالأرهاب وغيرهم كثير خاصة الأكراد والتركمان كان يتم الأعدام والخطف والسجن لهم من الشوارع ولا يتم تسليم اهل الضحية حتى جثته ! , المفتي منصب ضروري ولو على مستوى الأقاليم الكرد والوسط والجنوب وألا أعلان الحرب للدفاع عن العراق أو الجهاد من يعلنه وثم التصديق لقبول عدالة القضاء من يمنحها غير رجال الدين !
